Terms and Conditions

Welcome to eminentstudio.pk. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "Talent," or "Client") and Eminent Studio ("Company," "we," "us," or "our").

By accessing or using our website, mobile applications, or digital agency platform (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree, do not access or use our Services.

1. Account Registration and Eligibility

• Age Requirement: You must be at least 13 years old (or the legal age of majority in your jurisdiction) to create an account. Accounts registered for minors under 13 for talent portfolios must be created and operated by a parent or legal guardian.
• Accuracy & Identity Verification: You agree to provide accurate, complete information during registration. To maintain platform integrity and satisfy identity requirements under Pakistani law, Talent and Clients are required to provide complete personal details, including a valid Computerized National Identity Card (CNIC) or official government identifier upon request.
• Account Security: You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.

2. Platform Roles & User-Generated Content (UGC)

A. Talent & Client Portfolios

Eminent Studio provides a digital venue connecting talent with agency and client opportunities. Users (both Talent and Clients) can upload, submit, and share files, portfolio items, media assets, job briefs, and profile information ("User Content").

B. Ownership & Licensing of User Content

• Retention of Ownership: You retain all intellectual property rights in the User Content you upload to Eminent Studio.
• License Grant to Company: By uploading User Content, you grant Eminent Studio a non-exclusive, worldwide, royalty-free license to host, display, reproduce, adapt, and distribute your content solely for the purpose of operating, marketing, and promoting the platform and agency services on website and mobile app applications.

C. UGC Acceptable Use & Moderation Policy

To comply with Apple App Store and Google Play Store policies, as well as the Prevention of Electronic Crimes Act (PECA 2016):

• Zero Tolerance for Objectionable Content: You may not upload content that is defamatory, obscene, hate speech, abusive, infringing on third-party intellectual property, or sexually explicit.
• Content Moderation & Reporting: We reserve the right, but are not obligated, to monitor, review, or remove User Content at our discretion. Users can report inappropriate content or abusive accounts directly in-app or by emailing hello@eminentstudio.pk.
• Account Suspension: We reserve the right to immediately suspend or terminate any user account found violating these content standards.

3. Intellectual Property Rights

Except for User Content, all content, features, functionality, software code, design work, branding, and trademarks on eminentstudio.pk are the exclusive intellectual property of Eminent Studio. You may not copy, modify, distribute, or reverse engineer any part of our platform without prior written permission.

4. Advertisements, Third-Party Links, and Future Payments

• Advertisements: The platform displays third-party advertisements via Google AdMob, Meta Audience Network, and Monetag. We are not responsible for the availability, accuracy, or content of third-party advertisements or products.
• Third-Party Services: Your interactions with third-party networks, software libraries, or external services are governed by their respective terms and policies.
• Future Monetization & Payments: Eminent Studio reserves the right to introduce paid features, payment gateways, and subscription models in future updates. Additional payment terms will be published prior to the launch of any commercial payment features.

5. Account Termination & Deletion

• Termination by You: You may terminate your account at any time by utilizing the in-app account deletion setting or contacting hello@eminentstudio.pk.
• Termination by Us: We reserve the right to suspend or terminate your access to the platform immediately, without prior notice, if you breach these Terms, submit fraudulent identity details (e.g., false CNIC information), or engage in prohibited activities.

6. Disclaimers and Limitation of Liability

• "As Is" Basis:The Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied.
• No Guarantee of Match/Work: Eminent Studio does not guarantee employment, client engagements, or contract awards for Talent profiles listed on the platform.
• Limitation of Liability: To the maximum extent permitted under applicable law, Eminent Studio, its directors, employees, or agents shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from your use or inability to use the Services.

7. Governing Law and Dispute Resolution

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, including the Prevention of Electronic Crimes Act 2016 (PECA) and contract legal codes, without regard to conflict-of-law principles.
• Dispute Resolution: Any dispute arising out of or in connection with these Terms or the platform shall be submitted to the exclusive jurisdiction of the competent courts located in Pakistan.

8. Changes to These Terms

We may update these Terms from time to time. We will notify users of any material changes by posting the new Terms on this page with an updated "Last Updated" date. Your continued use of the platform following any modifications constitutes acceptance of the updated Terms.
